Auto Dealers Seek SC Help on GST Compensation Cess
Auto dealers in India are upset because they have a lot of money, around ₹2,500 crore, stuck in their GST accounts.
This money is from something called compensation cess, which was supposed to help the government during the transition to the new GST system.
The dealers want this money back or to be able to use it in their new GST accounts.
They asked the government nicely, but the government didn't do anything.
So now, they have gone to the Supreme Court to ask for help.
They want the Court to say that the government's rules about this money are not fair and to give them their money back.
The Court has said it will listen to what the government has to say before making a decision.
FADA filed a petition in the Supreme Court challenging the government's notifications on GST compensation cess.
The auto retailers seek a refund of approximately ₹2,500 crore in accumulated compensation cess credit.
The petition argues that the notifications are arbitrary and unconstitutional for not providing a mechanism for refund or utilization of the credit.
The Supreme Court issued notices to the Centre, with responses due by March 25, 2026.
FADA represents over 15,000 automobile dealerships employing around 5 million people.
