IBBI Suggests Guidelines to Avoid Dual Proceedings
Imagine there are referees in a game, and sometimes they make mistakes.
If a referee makes a mistake, they can get in trouble.
Now, there are two groups that can give the referees trouble: one is the main rule-making group (IBBI), and the other is like the referees' own club (IPAs).
Sometimes, the referees could get in trouble from both groups for the same mistake, which isn't fair.
So, the rule-makers are creating a new plan where both groups share information and talk to each other.
This way, they can make sure the referees are treated fairly and don't get punished twice for the same thing.
It also helps keep the game (the process of helping companies in trouble) running smoothly and honestly.
IBBI proposes new guidelines to prevent duplicate disciplinary actions against insolvency professionals (IPs).
The goal is to avoid 'double jeopardy' where IPs face multiple proceedings for the same issue.
Periodic data sharing and review meetings between IBBI and IPAs are suggested to coordinate efforts.
IBBI can suspend IP registrations, impose penalties, or order imprisonment for serious violations.
The new norms aim to make the disciplinary process fairer and more transparent.
