Delhi Court: Won't Act as Police's Agent in Real Estate Case
A Delhi court decided that it cannot simply agree with the police when deciding if someone is guilty.
It looked at the evidence against a real estate company and found that the company wasn't guilty of cheating, because the delay in building homes wasn't done on purpose.
The court did say the company may have broken the law by misusing money entrusted to them.
So, the court is sending the case back to the lower court to consider those charges.
Delhi court stated it won't act as an agent of police.
The court set aside an order that took cognizance of charges of criminal conspiracy and cheating against a realtor.
The court directed the magistrate court to proceed against the accused for criminal breach of trust and conspiracy.
The judge observed the chargesheet was a "jumble of allegations" and that cheating did not occur.
The court found the realtor-buyer relationship to be a seller-purchaser one.
