Delhi HC Overturns Lokpal Order in Mahua Moitra Case
The Delhi High Court has decided to cancel a decision made by the Lokpal that allowed the CBI to file charges against Mahua Moitra, a member of parliament.
The case is about an allegation that Moitra took money and gifts in exchange for asking questions in parliament.
The court said the Lokpal did not follow the correct procedure when it made its decision.
The court has asked the Lokpal to reconsider the case within one month.
Moitra's lawyers argued that the Lokpal did not properly follow the rules, while the CBI said Moitra did not have the right to present documents during the proceedings.
The court's decision means the CBI cannot file charges against Moitra for now.
The case started when another MP, Nishikant Dubey, complained that Moitra shared her parliamentary login details with a businessman, which could be a security risk.
Moitra admitted sharing her login details but denied taking any money or gifts.
Delhi High Court sets aside Lokpal order granting sanction to CBI for chargesheet against Mahua Moitra.
Court directs Lokpal to reconsider sanction under Section 20 of the Lokpal and Lokayuktas Act within one month.
Moitra's counsel argued that Lokpal violated procedural norms, specifically Section 20(7), which requires obtaining comments from public servants before granting sanction.
CBI opposed the plea, stating Moitra has no right to produce documents in Lokpal proceedings and is only entitled to give comments.
Allegations involve Moitra taking bribes and sharing her Lok Sabha login credentials with businessman Darshan Hiranandani, with BJP MP Nishikant Dubey filing the complaint.
