Delhi Court Rejects MCOCA Accused’s Bail Plea
A court in Delhi refused to release a man named Hariom on bail.
He is accused under a law used in cases involving organised crime.
The judge said that being in jail for a long time matters, but it does not automatically mean someone must be released under this law.
The judge also recognized that the Constitution protects a person’s liberty.
At the same time, the court said it must consider the safety of the public and the seriousness of the accusations.
The judge found that Hariom had apparently helped a crime group try to make illegal money.
Because of the allegations and the material considered by the court, his bail request was denied for now.
A Delhi court rejected Hariom’s bail application under the Maharashtra Control of Organised Crime Act.
Special Judge Gaurav Rao said prolonged custody alone cannot determine bail under laws with strict bail conditions.
The court acknowledged Article 21’s protection against prolonged pre-trial detention, while also noting the statute’s restrictions.
It said individual liberty must be balanced against public safety and the seriousness of the alleged offences.
The judge found Hariom had prima facie furthered a crime syndicate’s goal of generating illegal wealth.
