Telangana HC Allows FIR as Evidence Late in Trial
The Telangana High Court recently made an important decision in a murder case.
The lower court had refused to let the police add the First Information Report (FIR) as evidence because it was late in the trial.
The high court said this was a mistake.
They explained that courts should do everything possible to find the truth and ensure justice, even if it means adding evidence late.
The high court ordered the lower court to let the police add the FIR as evidence.
They also said the defence can object to this if they want.
This decision is based on a law called Section 311 of the Criminal Procedure Code, which gives courts the power to call witnesses or add evidence at any time if it helps in finding the truth.
The Telangana High Court allowed the prosecution to mark the FIR as evidence late in the trial.
The lower court had refused, stating it was too late in the proceedings.
Justice Anil Kumar Jukanti ruled that the lower court's decision ignored the need for a just outcome.
The case involves a 2018 murder over a property dispute in Kazipet.
The high court directed the lower court to recall the investigating officer to mark the FIR as an exhibit, with the defence given the chance to object.
