Orissa HC Upholds Adopted Son's Railway Job Claim
The Orissa High Court recently made a big decision about a railway job.
A man who was adopted wanted to get a job because his adoptive father, who worked for the railway, had passed away.
The railway said no because the adoption papers were registered after the father died.
But the court said that the adoption was still valid because it happened before the father died, even if the papers were registered later.
The court also said that the railway can make rules for these jobs, but they should be careful to make sure only real claims are accepted.
This decision is important because it shows that even if adoption papers are registered late, the adoption can still be valid if it happened earlier.
Orissa High Court upheld the compassionate appointment claim of an adopted son for a railway job.
The court noted that adoption is a matter of personal law for Hindus and is valid if rites are performed, regardless of when the deed is registered.
The railway's policy requiring adoption before the employee's death was found to be difficult to agree with by the court.
The court directed the railway to consider the adopted son's employment within two months.
The court cautioned authorities to exercise due diligence to prevent fake claims from prejudicing deserving candidates.
