Delhi High Court Awards Rs 3 Lakh to AIIMS Workers
The Delhi High Court decided that two people who used to work for AIIMS were fired illegally in 1995.
The court gave each of them a big payment of 3 lakh rupees.
It said they could not be put back in their old jobs because it had been more than 30 years.
The court also said that because AIIMS did not give them their work records, it was unfair.
The money is meant to settle all the problems caused by the illegal firing.
The court made it clear that illegal firing does not automatically mean the workers get their old jobs back or all the money they missed.
The decision was made on July 29, 2024, in Delhi.
The court used the law about illegal retrenchment to make its ruling.
The workers will get the money but will not return to their old jobs.
Delhi High Court ruled that two former AIIMS daily wagers were illegally retrenched in 1995.
Court awarded each worker a lump‑sum compensation of Rs 3 lakh, but declined reinstatement due to the passage of more than 30 years.
The decision cited AIIMS’ failure to provide employment records, leading to an adverse inference.
The compensation is considered a full and final settlement of all claims arising from the illegal retrenchment.
The order clarified that illegal retrenchment does not automatically entitle workers to reinstatement with back wages.
