Karnataka High Court Upholds Inspector’s Second Transfer After Approval

Karnataka High Court Upholds Inspector’s Second Transfer After Approval

A police inspector was transferred to another station only four days after joining a new one.

The transfer was made before the Police Establishment Board formally approved it.

The Board later gave its approval.

The Karnataka High Court said this later approval can sometimes fix the earlier paperwork problem.

However, the court said later approval does not automatically make every transfer valid.

The authority must have had the legal power to make the transfer.

There must also be no law stopping the Board from approving it afterward.

Justice H Shanthi Bhushan therefore allowed the transfer to stand in this case.
