Madras HC Allows TVK to Use Flag, Rejects Trademark Claim
A court in Chennai said that actor Vijay's political party, TVK, can keep using its flag.
Someone complained that the flag looked too much like their own, which they had registered.
The court looked at both flags and said they were different enough, even though they used some of the same colors.
The court also said that since neither the party nor the trust was selling things, trademark rules didn't really apply.
The case will continue, but for now, TVK can keep its flag.
Madras HC denied injunction to restrain Vijay's TVK from using its flag.
A trust claimed TVK's flag infringed their registered trademark due to color similarity.
The court found the flags' overall features different, rejecting the claim of substantial copying.
TVK argued the Trademark Act didn't apply as neither party engaged in trade or commerce.
The court dismissed the application for interim relief and adjourned the case to September 22.
