Delhi HC directs school reforms
The Delhi High Court has told the city government to make the Delhi School Tribunal stronger and create rules so that its decisions can be properly followed.
The court said this needs to be done quickly, within three months.
The court was hearing a case from an organization called Justice for All, which said that currently, there's no way for people to make sure the tribunal's decisions are carried out.
The court agreed that this is a problem and needs to be fixed soon.
The government said the case was not valid, but the court disagreed and said the issue needs immediate attention.
Additionally, the court directed the Directorate of Education to ensure that every school has a functional Parent-Teacher Association (PTA) and to record the steps taken so far.
This is important because a new law requires parents to be part of committees that regulate school fees.
Delhi High Court directed the government to strengthen the Delhi School Tribunal and frame rules for execution of orders within three months.
The court noted that the 2010 suggestion to frame such rules had not been implemented.
The petitioner, NGO Justice for All, argued that the current legal framework does not allow for execution of tribunal orders.
The government contended that the petition was an abuse of process and no unexecuted orders were shown.
The court emphasized that a tribunal must function within its statutory framework and execution mechanisms must be legally permissible, and directed the DoE to ensure PTAs in all schools.
