Allahabad HC: Absconding Accused Unfit for Anticipatory Bail
Imagine someone is accused of doing something wrong but runs away instead of facing the court.
The Allahabad High Court has said that if this happens, the person can't ask for 'get-out-of-jail-free' card (anticipatory bail) before they're even caught.
This decision came about after considering a case where a person, Pradeep Mishra, was accused of faking signatures on property papers.
He ran away after being notified.
The court decided he couldn’t get bail because he was hiding from the law.
His lawyer argued that he was innocent and that he would cooperate.
However, because he was avoiding authorities, the court denied him the bail.
Allahabad High Court ruled absconding accused are not entitled to anticipatory bail.
The ruling was in response to the anticipatory bail plea of Pradeep Mishra.
Mishra is accused of forging signatures on property documents.
An FIR was lodged at Kanpur Nagar Kotwali regarding the fake documents.
The court cited Supreme Court precedent in its decision.
