Goa Bill Prohibits Tenant House Transfer Without Consent
The Goa government has introduced a new Bill to protect tenants, called 'mundkars,' who have lived in their homes for a long time.
This Bill says that landlords cannot sell or transfer these homes to anyone else without the tenant's permission.
The tenant must agree to any such transfer, and the agreement must be officially recorded.
If someone tries to transfer the home without the tenant's consent, that transfer will not be valid.
The Bill aims to make sure that tenants have the right to stay in their homes and that their rights are protected.
The Goa government introduced the Goa Mundkars (Protection from Eviction) (Amendment) Bill, 2026 to prohibit the transfer of tenant-occupied houses without their consent.
The Bill amends the Goa Mundkars (Protection from Eviction) Act, 1975 by substituting Section 9, which deals with restrictions on the transfer of dwelling houses by landlords.
No landlord will be allowed to transfer a mundkar’s dwelling house to any person other than the mundkar without their consent through a registered instrument.
The mundkar must be a confirming party to any such transaction, and any transfer in contravention of these provisions will be null and void.
The amendment aims to strengthen the protection afforded to mundkars and prevent the alienation of their dwelling houses without their consent.
