REAT Rules Successor Developer Must Honour Original Allotment
A long-pending housing dispute in Mumbai was finally resolved by the Real Estate Appellate Tribunal (REAT).
A woman named Sangeeta Punjabi had booked a flat in 2010, but the project was stalled for years.
The original developer, M/s Super Constructions, transferred the development rights to a new promoter, M/s Sai Enterprises, in 2017.
The new promoter launched a different project and refused to honour the old booking, claiming they were not liable.
However, the REAT ruled that the new promoter must honour the original allotment and allot a flat of equivalent area to Sangeeta Punjabi.
The new developers were also ordered to pay interest on the amount paid by the homebuyer from 2013 until possession is handed over.
