Allahabad HC Quashes Theft Case Over Limitation Period
The Allahabad High Court has canceled a theft case because the court took too long to start the legal process.
The court said that the case should have been started within three years of the theft, but it was started much later.
The court also told other judges to be more careful when starting criminal cases in the future.
The case was about a motorcycle that was stolen in 2019.
The police took a long time to finish their investigation and send the case to the court.
The court said that this was not right and canceled the case against one of the people involved, Avneesh Kumar.
Allahabad High Court quashed criminal proceedings in a theft case due to cognizance taken beyond the three-year limitation period.
The case pertained to a motorcycle theft incident in July 2019, with the FIR lodged under IPC Section 379.
The first chargesheet was filed promptly in 2019, but the investigation against Avneesh Kumar and Suraj Thakur remained pending.
The second chargesheet was prepared in June 2021 but submitted to the court in November 2024, ignoring the limitation period.
The court directed the Judicial Training and Research Institute to train judicial officers on the importance of passing cognizance orders in accordance with the law.
