Orissa High Court Upholds Divorce in Eroded Marriage

A husband asked the Orissa High Court to undo a divorce granted to his wife.

He said the claims against him had not been proved and that he wanted the marriage to continue.

His wife’s lawyer said she had provided evidence of physical and mental cruelty.

The judges considered the incidents together and said they showed ongoing problems, not just one argument.

They said trust and other important parts of the relationship had substantially eroded.

The couple had also told the court they wanted to end the marriage.

The judges stressed that wanting to separate alone was not the reason for the divorce.

They upheld the divorce because they found cruelty had been established by the evidence.
