Karnataka High Court Says Separate Rooms Alone Aren’t Marital Cruelty

Karnataka High Court Says Separate Rooms Alone Aren’t Marital Cruelty

The Karnataka High Court considered a case involving a married couple who lived in separate rooms.

The judges said that having separate rooms is not automatically cruel.

They explained that courts must look at the whole history of the marriage.

In this case, the couple had experienced long-term arguments, alleged abuse, emotional neglect and failed attempts to reconcile.

The wife eventually left the home with the children.

The husband disagreed with the allegations and appealed the divorce decision.

The court said the combined effect of the problems was enough to show mental cruelty.

It also said the wife’s acquittal in a criminal complaint did not automatically mean her complaint was false, and upheld monthly alimony of Rs 25,000.
