Karnataka HC quashes detention order for language violation
The Karnataka High Court canceled a one-year prison sentence for a man because some of the important papers he was given were in English, but he only understands Kannada.
The court said this was unfair because he couldn't properly understand why he was being punished.
The man's mom asked the court to help, and the judges agreed that the rules were not followed correctly.
The man had been in trouble before, but the court said the authorities didn't look at all the facts when they decided to keep him in prison.
So, the court told the prison to let him go right away.
Karnataka High Court set aside a detention order due to documents not being in Kannada.
The detenue, who only reads Kannada, was provided with some documents in English.
The court found that the detention order violated the detenue's constitutional rights under Article 22(5).
The detenue was acquitted in 8 of the 13 cases filed against him, but the detaining authority did not consider these acquittals.
The court directed the prison authorities to release the detenue immediately.
