Mumbai Society Wins ₹25.40 Lakh Dues Recovery
A housing society in Mumbai won a court order to recover ₹25.40 lakh in unpaid maintenance fees from nine members.
These members, who include both shop owners and flat owners, had been using the society's services like security and water supply without paying their dues.
The society had sent multiple notices and reminders, but the members did not pay.
The court said that all members must pay maintenance fees to keep the society running, and the defaulters now have to pay the outstanding amount plus interest.
The Deputy Registrar of Co-operative Societies ordered nine members of Indraprastha Regency CHS to pay ₹25,40,195 in pending maintenance dues.
The defaulters, including two shop owners and seven residential flat holders, continued to use society services without payment.
The society issued multiple demand notices starting from January 1, 2023, but the members did not comply.
The court ruled that payment of maintenance is mandatory for all members under the Maharashtra Co-operative Societies Act.
Each defaulter was directed to pay a specified amount, with the highest being ₹6,31,926 and the lowest ₹85,307.
