Telangana HC Issues Key Rulings on Legal Cases
The Telangana High Court made important decisions in three different cases.
In one case, they said that to be guilty of cheating, a person must have had bad intentions from the start.
They stopped a case against a man who had borrowed money but didn't repay it, because there was no proof he planned to cheat.
In another case, they said that just because a cheque bounces doesn't mean someone is automatically guilty.
They stopped a case against a man because the complaint didn't show he was responsible.
In the third case, they said it's not fair to keep workers as temporary employees for a long time if their jobs are permanent.
They told the authorities to consider making a sweeper who worked for many years a permanent employee.
Telangana High Court quashed criminal proceedings against Polasa Ravi Kumar, stating that cheating requires fraudulent intent at the inception of the transaction.
The court held that continued criminal proceedings in the absence of dishonest intention amount to an abuse of the legal process.
Justice Juvvadi Sridevi quashed proceedings against L. Ramesh in a cheque bounce case, stating that mechanical issuance of summons without judicial application of mind is impermissible.
The court directed authorities to consider the regularisation of services of a full-time sweeper, B. Ananthaiah, who had been working continuously for several decades on a temporary basis.
The judge observed that prolonged engagement of employees on a temporary basis for work of a perennial nature is legally unsustainable and amounts to unfair labour practice.
