Constable Wins Rs 75,000 for Credit Score Error
A police constable in Tamil Nadu bought a washing machine and paid the full amount.
Later, he found out that someone else had taken loans in his name through Bajaj Finance and defaulted on them.
This made his credit score drop, and he couldn't get a loan.
He complained to the Kerala District Consumer Commission, which found Bajaj Finance responsible for the mistake.
The commission ordered Bajaj Finance to correct his credit report and pay him Rs 75,000 for the trouble caused.
The commission also said that TransUnion CIBIL, which keeps credit records, is not responsible for the mistake because it just stores the information given by banks and financial companies.
A police constable's CIBIL score dropped to 627 due to fraudulent loans taken in his name by another person through Bajaj Finance.
The Kerala District Consumer Commission found Bajaj Finance liable for submitting incorrect credit information to TransUnion CIBIL.
The commission ordered Bajaj Finance to correct the constable's credit information and pay Rs 50,000 for deficiency in service and mental agony, plus Rs 25,000 in litigation costs.
TransUnion CIBIL was not held responsible as it only acts as a repository of information provided by member institutions.
The judgment reinforces the need for thorough verification of borrower identities by financial institutions before reporting credit information.
