Delhi HC Seeks Customs Response to IndiGo's Rs 900 Crore Duty Refund Plea
IndiGo, the airline company, is asking the Delhi High Court for a refund of Rs 900 crore.
This money was paid as Customs duty on aircraft engines and parts that were sent abroad for repairs and then brought back to India.
IndiGo says that paying this duty again is not fair because they already paid duty when they first imported the parts.
The Customs department says the court should wait because the Supreme Court is already looking at a similar issue.
The High Court has asked the Customs department to respond by the next hearing in April 2026.
Delhi High Court seeks Customs department's response to IndiGo's plea for Rs 900 crore duty refund.
IndiGo claims Customs duty on re-imported aircraft engines and parts is unconstitutional and amounts to double levy.
Customs department argues the plea is premature and the issue is pending in the Supreme Court.
IndiGo paid duty under protest for over 4,000 bills of entry and later filed refund claims, which were refused.
The Customs tribunal had earlier ruled that duty cannot be levied again on re-imports following repairs.
