Supreme Court Rules on Passport Renewal for Pending Cases
The Supreme Court of India said that people who are in the middle of a criminal case can't be stopped from renewing their passports.
The court explained that the freedom to travel is a basic right, and only the courts handling the criminal case can decide if someone can travel abroad.
The case was about a man named Mahesh Kumar Agarwal who was having trouble renewing his passport because he was involved in a criminal case.
The Supreme Court said that the passport office should not decide if someone can travel, that's the job of the criminal court.
So, if a criminal court says it's okay for someone to travel, then their passport should be renewed.
The Supreme Court ruled that passport renewals cannot be denied to individuals facing criminal cases without a court order.
The court emphasized that the freedom to travel is a fundamental right under Article 21 of the Constitution.
Mahesh Kumar Agarwal's appeal was allowed, challenging the Calcutta High Court's decision to refuse passport renewal due to a pending criminal case.
The NIA court in Ranchi and Delhi High Court had permitted Agarwal to travel abroad subject to certain conditions.
The Supreme Court clarified that the passport authority cannot withhold renewal if the jurisdictional criminal court permits travel.
