Andhra Pradesh High Court Rules on Employee Gratuity Rights
A man who worked for a cooperative society and a bank for many years was not paid his full salary and retirement benefits when he retired.
He asked the court to make his employers pay him what he was owed.
The court said that the right to receive gratuity (a type of retirement benefit) is a legal right and cannot be taken away.
The court ordered the cooperative society to pay the man his unpaid salary and retirement benefits, including gratuity and leave encashment, with extra money (interest) for the delay.
The court also said that the employers cannot use not having enough money as an excuse for not paying what they owe.
The Andhra Pradesh High Court ruled that the right to gratuity is a statutory right and cannot be taken away except through the procedure enunciated under the law.
The court directed the cooperative society to release the gratuity amount and leave encashment with 10% annual interest from the date the amount became payable until the date of actual payment within 10 weeks of the date of receipt of the court order.
The petitioner, who was appointed in 1977 and retired in 2011, was not paid his arrears of salary for 35 months and his terminal benefits, including gratuity, earned leave encashment, and provident fund.
The cooperative society and the bank initially denied responsibility for the payment, citing financial incapacity and incorrect legal proceedings, respectively.
The court emphasized that financial incapacity cannot be a valid defense for non-fulfillment of statutory obligations, and employers are liable to pay terminal benefits under the Payment of Gratuity Act, 1972.
