Emergency '75 and Its Impact on the Indian Constitution
In 1975, India's government, led by Indira Gandhi, declared a state of emergency.
This meant the government had more power and could limit people's rights.
Some people thought Indira wanted too much power.
During this time, many changes were made to the Constitution.
Later, the government changed again, and they undid some of those changes, making it harder to declare an emergency and protecting people's basic rights more.
The aim was to balance the government's powers and protect citizens.
Emergency '75 was proclaimed using Article 352(1), initially interpreted broadly.
Indira Gandhi's government amended the Constitution multiple times, including the 42nd Amendment.
The 42nd Amendment was described as a "mini-Constitution" and altered many articles.
The Janata Party's 44th Amendment made it more difficult to impose an emergency.
Amendments like those by Indira and the Janata Party influenced the balance of power.
