Bombay HC Rules on Redevelopment Disputes
The Bombay High Court said that if two people own a flat together and one of them lives there, that person gets all the benefits from any redevelopment work, even if there's a disagreement between the owners.
The court told the person living in the flat to move out by January 15, 2026, so the redevelopment can happen.
Most of the other flat owners in the building agreed to the redevelopment, so the court wanted to make sure the project could go forward.
The court also said that both owners need to sign a special agreement about temporary housing during the redevelopment, but that agreement depends on the outcome of their dispute.
Bombay High Court ruled that the occupant in possession of a jointly owned flat is entitled to redevelopment benefits despite co-ownership disputes.
The dispute involved Flat No. 6 in Charkop Shreeji Krupa Co-operative Housing Society, jointly owned by Sanjay M. Singh and Sandhya R. Singh.
Sanjay Singh, who was in possession, had opposed vacating the flat, stalling the redevelopment project since September 2025.
The court directed Sanjay Singh to hand over vacant possession of the flat to the developer by January 15, 2026.
The court clarified that the Permanent Alternate Accommodation Agreement (PAAA) must be signed by all co-owners, subject to the outcome of their legal dispute.
