Mumbai MACT Rejects ₹25 Lakh Claim, Awards ₹2 Lakh
A family in Mumbai asked for ₹25 Lakh because their husband and father died after being hit by a bus.
The court said no because he died from liver problems, not the accident.
They did give the family ₹2 Lakh because the accident did hurt him.
The bus company said the family waited too long to ask for money and that the man was not careful when crossing the road.
The court looked at the medical reports and agreed that the accident did not cause his death.
They gave some money for the pain and trouble caused by the accident.
Mumbai MACT rejected a ₹25 Lakh compensation claim for a 2010 accident, citing death from alcoholic liver cirrhosis.
The tribunal awarded ₹2 Lakh for accident-related suffering, noting an FIR was filed against the BEST bus driver.
The claim was filed in 2022, 12 years after the accident and 8 years after the death, with no satisfactory explanation for the delay.
BEST contested the claim, arguing no evidence linked the accident injuries to the death and alleging contributory negligence by the deceased.
Medical records and post-mortem reports showed the cause of death was pulmonary tuberculosis with cirrhosis of the liver due to alcohol consumption.
