SC Restricts Karnataka HC Ruling on Organised Crime Act
The Supreme Court said that a recent decision by the Karnataka High Court about a law called KCOCA, which is used against organized crime, should not be used as an example for other cases.
The High Court had said that this law was wrongly used against a politician named Byrathi Basavaraj, who is accused in a murder case.
The Supreme Court wants to make sure that the High Court's decision doesn't cause confusion in other cases.
The murder case is about a real estate agent named Bikla Shiva, who was killed in Bengaluru.
The politician is linked to a gang involved in real estate disputes.
The Supreme Court is still deciding on the matter and said that the High Court's decision should not be followed as a rule in other cases.
The Supreme Court stated that the Karnataka High Court's decision to quash KCOCA charges against BJP MLA Byrathi Basavaraj should not be relied upon as a precedent.
The Karnataka High Court had set aside the invocation of KCOCA against Basavaraj, arguing that the law was incorrectly applied due to the absence of evidence of continuing criminal activity by an organised gang.
The Karnataka High Court's decision extended to 20 other individuals accused in the murder of realtor Bikla Shiva.
The Supreme Court bench raised concerns about the interpretation of the
which requires a minimum of three years of imprisonment for invoking KCOCA.
The murder of Bikla Shiva is alleged to be linked to a property dispute dating back to February 2025.
