Tribunals award compensation to families of 2019 and 2020 accident victims
Two different tribunals in India have awarded compensation to the families of two men who died in separate road accidents.
In the first case, a businessman named Shashikant Ingle died in a 2020 accident when a trailer suddenly stopped without warning.
The tribunal found the trailer driver mostly at fault (85%) and awarded Rs 92.53 lakh to Ingle's family.
In the second case, a 29-year-old man named Dileep Kumar died in a 2019 accident when a truck suddenly braked in front of his car.
The tribunal found the truck driver responsible and awarded Rs 56.33 lakh to Kumar's family.
Both tribunals ordered the insurance companies to pay the compensation.
These decisions help the families of the victims, who were the sole breadwinners, to cope with their loss.
The Motor Accident Claims Tribunal (MACT) in Thane awarded Rs 92.53 lakh to the family of Shashikant Ingle, who died in a road accident in 2020.
The accident occurred when the trailer ahead abruptly applied brakes without indication, and Ingle collided with it.
The tribunal found the trailer driver 85% negligent and the victim 15% negligent for not maintaining a sufficient distance.
Ingle was the sole breadwinner for his wife, two minor daughters, and elderly parents.
The tribunal ordered the vehicle owner and insurance company to pay the compensation jointly within one month.
A Delhi motor accident claims tribunal awarded Rs 56.33 lakh to the family of Dileep Kumar, who died in a road accident in Noida in 2019.
The accident occurred when a truck allegedly overtook Kumar's car at high speed before applying sudden brakes, causing the car to ram into it from behind.
The tribunal held that the truck driver's rash and negligent driving was responsible for the accident.
The insurance company, HDFC ERGO General Insurance Co Ltd, was ordered to pay the full compensation amount as the truck was insured at the time of the accident.
Both tribunals noted that the families of the victims were dependent on the deceased and awarded compensation under various heads, including loss of dependency.
