Allahabad High Court Rules Interim Maintenance from Filing Date
The Allahabad High Court recently made an important decision about interim maintenance for women.
A woman named Sonam Yadav had asked for interim maintenance from a family court in Kaushambi, Uttar Pradesh.
The family court decided to give her maintenance, but only from the date of their order, not from when she first applied.
The high court said this was not fair and changed the decision.
They ruled that interim maintenance should start from the date the application was filed, not the date of the court's order.
This is to make sure women do not suffer financially while waiting for the court to decide their case.
The court also said that maintenance applications often take a long time to be decided, and women should not have to wait without support.
They referred to a previous Supreme Court decision that supports this idea.
The high court's decision helps protect women who need financial support and ensures they get it as soon as possible.
Allahabad High Court ruled that interim maintenance should be granted from the date of filing the application, not the order date.
Sonam Yadav filed for interim maintenance on August 5, 2024, but the family court ordered payment only from April 3, 2025.
The high court modified the family court's order, directing payment from the application date to prevent financial hardship.
The court referred to the Supreme Court's 2021 ruling in Rajnesh Vs Neha, which supports awarding maintenance from the application date.
The high court emphasized that delays in maintenance applications should not disadvantage the applicant.
