HC Orders Haryana to Restore Full Benefits to Employee
A man named Adesh Kumar worked for the Haryana government.
In 1998, some of his juniors were promoted to a higher position, but he was left out.
He went to court and won.
The court said the government should have promoted him at the same time as his juniors and should give him all the money he missed out on, plus extra interest.
The court told the Haryana government to pay him all that money back.
The Punjab and Haryana High Court directed the Haryana government to pay arrears with 9% annual interest to Adesh Kumar, a former revenue department employee.
Kumar was denied monetary benefits despite being granted retrospective promotion more than two decades ago.
The court held that the State had implicitly accepted Kumar's rightful claim but failed to provide the consequential financial benefits.
Justice Sandeep Moudgil passed the order while allowing Kumar's petition challenging a 1998 order by the Ambala Deputy Commissioner.
Kumar sought quashing of the 1998 order and a direction to grant him promotion from the same date as his juniors, along with all consequential benefits.
