Orissa High Court Sets Aside NGT's Rs 96 Crore Penalty
The Orissa High Court decided to cancel a big fine of Rs 96 crore that the National Green Tribunal (NGT) had given to a mining company.
The court said the NGT's decision was not fair and didn't follow the right rules.
A man named Prahallad Biswal had asked the court to look at this, and the court agreed that the NGT's decision was not proper.
The court said that when decisions are made unfairly or without good reasons, higher courts should step in.
Now, the case will be looked at again by the right authorities to make a new decision.
Orissa High Court set aside NGT's Rs 96 crore environmental compensation order.
The court found the NGT order to be manifestly arbitrary and lacking in proportionality.
Justice Sanjeeb K Panigrahi observed that high court interference is justified in cases of natural justice violations.
The matter was referred back to the competent authority for fresh consideration.
The petition was filed by Prahallad Biswal challenging the NGT's decision.
