Gujarat HC Rules Existing SC/ST Benefits Cannot Be Revoked
The Gujarat High Court recently made an important decision about reservation benefits for Scheduled Castes (SCs) and Scheduled Tribes (STs).
The court said that if a community is removed from the SC/ST list, people who already got benefits from being in that list will keep those benefits for their lifetime.
This means that if someone was born into a caste that was on the SC/ST list at that time, they will continue to get those benefits even if the caste is later removed from the list.
However, people born after the caste was removed will not get these benefits.
This case was about a man named Ranjit Vasantlal Makwana who was promoted under the SC quota.
Later, the government changed the rules, and his promotion was taken away.
The court decided that he should keep his promotion because he was eligible when he got it.
The Gujarat High Court ruled that removing a caste from the SC/ST list does not revoke already granted benefits.
The court held that changes to the SC/ST list are prospective and cannot deprive individuals of previously conferred rights.
Ranjit Vasantlal Makwana, a member of the Mochi community, was promoted under the SC quota in 1995.
In 2002, the SC status for the Mochi community was restricted to specific areas, leading to the reversal of Makwana's promotion in 2012.
The Central Administrative Tribunal ruled in favor of Makwana, restoring his promotion, and the Gujarat High Court upheld this decision.
