Telangana HC Upholds Cancellation of ST Certificates
The Telangana High Court has dismissed an appeal by a family who were trying to keep their ST-Lambada caste certificates.
The court said the family couldn't challenge the cancellation because they had other legal options.
The family had moved to Telangana from Maharashtra in 1956, which was after a law was made in 1950 that said only certain tribal groups could get these certificates.
The court also found that the family had used fake documents to get the certificates.
The court said the family didn't prove they were eligible before 1950, and they even lied about not getting notices.
So, the court agreed with the earlier decision to cancel their certificates.
The Telangana High Court dismissed an appeal against the cancellation of ST-Lambada caste certificates for Chouhan Devanand and his six children.
The court ruled the appeal was not maintainable as the family had other legal remedies under the 1993 Act.
The family migrated from Maharashtra in 1956, after the Constitution (ST) Order, 1950, making them ineligible for ST-Lambada status.
The court found the family used fabricated documents, including letters from the All India Banjara Seva Sangh, to obtain the certificates.
Criminal complaints were filed against two family members for forging documents to get the certificates.
