HC Upholds Injunction on Woman Claiming Marital Status
A woman named Maya Dhakad went to court because she wanted to be recognized as the wife of a man named Bharat Dhakad.
However, Bharat was already married to someone else.
The court said that since Bharat was already married, any marriage ceremony with Maya was not legal.
The court also said that some documents, like a letter and an affidavit, could not make the marriage legal.
The court decided that Maya should not be allowed to say she is Bharat’s wife.
The court agreed with an earlier decision that stopped Maya from doing this.
So, Maya’s request to the court was not accepted.
The Indore Bench of the Madhya Pradesh High Court dismissed a petition by Maya Dhakad challenging an injunction that restrained her from claiming marital status with Bharat Dhakad, who is already married.
The court ruled that any marriage performed during the subsistence of Bharat’s first marriage is void under Section 11 of the Hindu Marriage Act.
Maya alleged that Bharat presented himself as a widower and performed a marriage ceremony with her in May 2016, which she later discovered was invalid due to his existing marriage.
The court held that documents such as a Daan Patra and an affidavit by Bharat’s first wife could not override the statutory law making the marriage void.
The High Court affirmed the District Judge’s October 14, 2025 order, stating that the injunction was legal, proper, and justified.
