HC: CRPF Discrimination Against HIV+ Staffer Illegal
A court in Gujarat said it's wrong to deny a promotion to a CRPF employee just because they have HIV/AIDS.
The court explained that this goes against a law that protects people with HIV/AIDS from unfair treatment at work.
Because of this, the court has ordered the CRPF to promote the employee to a higher rank and consider her for an even higher position, just like her coworkers who were promoted at the same time.
The court also said the rules that caused the denial were wrong and need to be changed so this doesn't happen to others in the future.
Gujarat High Court ruled that denying promotion to an HIV/AIDS positive CRPF staffer was discriminatory.
The court directed CRPF to promote the staffer to Inspector (Ministerial) and consider her for Assistant Commandant.
The court declared a 2008 Standing Order and 2011 recruitment rules cited for denial as "ultra vires".
The ruling cited the HIV/AIDS (Prevention & Control) Act, 2017, which prohibits employment discrimination.
The court stated the CRPF must amend its rules to remove discrimination against HIV/AIDS positive individuals.
