Delhi Court Acquits Kejriwal in ED Summons Cases
Arvind Kejriwal, the former Chief Minister of Delhi, was cleared by a Delhi court in two cases.
The Enforcement Directorate (ED) had filed these cases because Kejriwal did not respond to their summons related to an investigation into the Delhi Excise Policy.
The court said that the ED did not prove that the summons were properly sent or that Kejriwal intentionally ignored them.
The court also mentioned that sending summons via email is not legal under the current laws.
Therefore, Kejriwal was acquitted of the charges.
The investigation started after the Central Bureau of Investigation (CBI) registered a case based on a complaint about the excise policy.
The court postponed further deliberation until 7 February.
A Delhi court acquitted Arvind Kejriwal in two cases filed by the Enforcement Directorate (ED) for not appearing before the ED in response to summons related to the excise policy probe.
The court found that the ED failed to prove the due service of summons and that the process of issuing summons via email was not in accordance with the law.
The court stated that the ED did not provide a supporting affidavit under Section 65 B of the Evidence Act to prove the service of summons.
The court underlined procedural, legal, and factual challenges to the ED’s case regarding Kejriwal’s culpability.
The court said that the prosecution failed to prove its case beyond a reasonable doubt, and Kejriwal was entitled to be exonerated of the charge against him.
