Kerala High Court Dismisses Bank Retirees' GST Exemption Petition
The Kerala High Court recently said no to a request from retired bankers to not charge GST on their group health insurance.
The retirees wanted the same GST exemption that is given to individual health insurance policies.
The court explained that their group policy is different because it is managed by the Indian Banks’ Association and offers special rates and benefits.
Earlier, there was a temporary order to not charge GST, but the court has now decided that group policies do not get this exemption.
Around 1.5 lakh retired bankers are part of this group policy.
The Kerala High Court dismissed a petition by bank retirees seeking GST exemption on their group health insurance premiums.
The court ruled that GST exemption is intended for individual policies, not group policies managed by the Indian Banks’ Association (IBA).
The group policy offers better rates and additional benefits through collective bargaining, which are not available to individual policyholders.
Around 1.5 lakh retired bankers are part of the IBA group health insurance policy managed by the IBA and the National Insurance Company.
The court's decision overturns an earlier interim stay order that had temporarily exempted GST on group policies for retired bankers.
