India's Mediation Act Faces Uncertain Future
Imagine India's courts are overloaded with cases, like a busy playground.
To help, a new law called the Mediation Act was created to encourage people to solve disagreements through mediation – like having a grown-up help kids sort out their problems.
This law was passed in 2023, but it's not being used much yet.
Even though the government says they want mediation, they haven't fully put the law into action.
Many people, including the courts and legal professionals, want it to work to help people solve conflicts faster.
The law is waiting to be used.
The Mediation Act of 2023 was passed to promote mediation for civil and commercial disputes.
The Supreme Court proposed the standalone legislation over five years ago.
The Act received President's approval on September 15, 2023, but has not been fully implemented.
A 90-day mediation drive is ending September 30 with unknown impact.
Over 4.77 crore cases are pending in Indian courts.
