Telangana HC Reduces Murder Conviction to Culpable Homicide
A man named Dharavat Bhav Singh was originally sentenced to life in prison for killing his wife.
The Telangana High Court changed this to a lesser charge because they believed he acted in anger during a fight, not with the clear intention to kill.
The court said he used a pestle, which is not usually a weapon for murder, and there was no plan to kill his wife.
Because of this, the court decided he should only serve the time he already spent in jail, which was from 2018 until early 2024.
The court explained that just knowing your actions could cause death is different from actually intending to kill someone.
Telangana High Court reduced Dharavat Bhav Singh's murder conviction to culpable homicide not amounting to murder.
Singh struck his wife with a pestle during a quarrel, causing fatal injuries on April 6, 2018.
The court noted that the act was committed in a fit of anger without premeditation or deliberate intent.
Singh was sentenced to the time he had already served in jail from September 2018 to early 2024.
The court distinguished between 'intent' and 'knowledge' under the Indian Penal Code, finding no clear intention to kill.
