Allahabad HC Orders UP Police to File Complaints Against False Accusers
The Allahabad High Court in India has told the police in Uttar Pradesh to file complaints against people who make false or malicious complaints.
This order came from a case where a husband and wife were fighting, and the husband made some accusations against his wife.
The police found no proof, but the wife was still called to court.
The judge said the police should have followed different rules and should now take action against people who lie to the police.
This is to make sure people don't misuse the legal system.
Allahabad High Court directed Uttar Pradesh Police to file written complaints against individuals who lodge false or malicious complaints.
The order came in a marital dispute case where the husband's allegations were found to be baseless by the police.
The court noted procedural lapses, including the wrongful registration of an FIR under Section 154 instead of Section 155 of the CrPC.
The judge emphasized that police must file complaints against complainants and witnesses who provide false information when closure reports favor the accused.
The court also highlighted that the Aligarh court failed to provide the accused with a mandatory pre-cognisance hearing as per the BNS.
