Insurers begin advance payments to victims of Toledo train crash

After a train collision in Toledo, insurers QBE and Intact Insurance have begun arranging advance payments for victims.

QBE covers civil liability for rail infrastructure manager Adif and train operator Renfe, while Intact covers operator Iryo.

Under the rules described, the railway companies must pay at least €21,000 per person killed or injured within 15 days of the accident.

The advance is meant to help meet immediate needs and does not mean the railway company or insurer accepts responsibility.

The payment generally cannot be reclaimed, except if a passenger’s negligence caused the accident.

Civil liability claims can take years to resolve, with courts often deciding the outcome.

Other insurance policies may also cover damage and passengers, while the judicial process continues.
