Germany’s draft fuel price cap would apply only under strict conditions
Germany’s Economy Ministry has drafted a law allowing the government to cap petrol and diesel prices at public filling stations.
The cap would be used only if prices outpace the EU average for three weeks in a row by more than five percentage points.
It would last for no more than three months, and officials could suspend it if fuel supplies were at risk.
The draft also lets states set different caps to reflect local conditions, including in specific areas.
The proposal is in an early stage of government review, and the current fuel tax discount ends in December.
The coalition wants the cap to take effect from January 2027, but the draft is not yet final.
Some Social Democrats say the conditions are too strict and want a measure that can provide relief sooner.
Germany’s draft fuel price cap would be limited to a maximum of three months.
The proposed cap would apply only if petrol and diesel prices exceeded the EU average by more than five percentage points for three consecutive weeks.
The draft allows the measure to be suspended if fuel supplies are at risk and lets states set different regional price limits.
The proposal is in an early stage of coordination within the federal government.
The draft is intended to replace a temporary fuel tax rebate that expires at the end of 2026.
- Who
- Germany’s Federal Ministry for Economic Affairs, led by Katherina Reiche, prepared the draft. The coalition and state governments are involved in the plan.
- What

- When
- The draft says the law is to take effect on 1 January 2027. The cap would be triggered only after three consecutive weeks meeting the price threshold.
- Where
- Germany, with states able to set different price limits in their regions.
- Why

What people are saying
If excessive price increases have to last three weeks before Reiche acts, that helps no one.
If maximum prices are set too low, fuel deliveries can become uneconomic. Imports could fail to arrive and supply shortages could arise.
