India eases GST rules for post-sale discounts from November 1
India will implement several GST changes on November 1 under provisions of the Finance Act, 2026.
GST is the tax system that applies to the supply of goods and services in India.
Previously, businesses could exclude a post-sale discount from the taxable value only if it was agreed before or at the time of supply and linked to the relevant invoices.
That advance-agreement requirement is being removed, but the supplier must issue a credit note and the recipient must reverse the related input tax credit.
The changes also allow eligible businesses facing an inverted duty structure—where input taxes exceed taxes on sales—to receive 90% of a claimed refund provisionally, subject to conditions and checks.
The ₹1,000 minimum for certain export refunds is also being removed for goods exported with tax paid.
The provisions take effect on November 1, and eligible refunds will be settled finally after scrutiny.
India will simplify GST rules for post-supply discounts from November 1, removing the requirement for an agreement made at or before the time of supply.
Eligible discounts may be excluded from the value of supply if the supplier issues a credit note and the recipient reverses the related input tax credit.
The changes are part of amendments to the GST Act prescribed in the Finance Act, 2026.
From November 1, eligible businesses claiming refunds because of an inverted duty structure can also receive provisional refunds of 90% of the claimed amount, subject to conditions and verification.
The changes are intended to ease practical difficulties for businesses offering dealer incentives and other post-sale discounts.
