Indonesia Bill Would Target Assets From Investment and Other Scams
An Indonesian parliamentary working group says the proposed asset-forfeiture bill would cover several types of scams, including fake investments, illegal insurance and fraudulent religious travel services.
The group cited cases involving investment schemes such as Binomo and Quotex, trading schemes and misleading umrah travel services.
Its deputy chair, Soedeson Tandra, said the bill would let authorities seize perpetrators’ assets linked to these crimes.
If those assets are not enough to cover victims’ losses, other property belonging to the perpetrators could also be seized, even if it did not come from the crime.
Tandra said some people convicted of investment fraud have kept the proceeds because their property could not be taken.
The working group is continuing to develop the bill and has received input from the public, professional organizations and experts.
It hopes to discuss the bill with the government soon, with the aim of having it passed into law.
A working group in Indonesia’s House of Representatives says a proposed asset-forfeiture bill will cover investment, savings-club, insurance and cooperative scams.
The bill could allow authorities to seize assets from people convicted of those crimes.
Other assets not directly obtained through crime could also be seized to cover losses if criminal proceeds are insufficient.
Working group deputy chair Soedeson Tandra said the proposal would soon be discussed with the government.
Lawmaker M. Nasir Djamil welcomed the proposal, saying it could help protect people who have been defrauded.

What people are saying
We will include crimes in the fields of fraudulent investments, insurance, fraudulent savings clubs, fraudulent cooperatives, and religious pilgrimage travel agencies, for example fraudulent umrah and hajj services.
There are many cases of fraudulent investments where people are sentenced. But because their property cannot be seized, they get to enjoy the proceeds of the fraud.
This is a breath of fresh air for law enforcement in Indonesia.
With this law, law enforcement can identify and trace the assets of fraudulent investment perpetrators from the outset of legal proceedings.
